1. Agreement
By engaging Buildabase and paying a deposit, the client agrees to these Terms of Service in full.
2. Project Scope
All work is based on the agreed scope outlined in the project brief. Changes to scope may affect price and timeline and must be agreed in writing before work proceeds.
3. Client Responsibilities
The client agrees to: provide all required content, assets, and information in a timely manner; respond to review requests within 5 business days; and provide consolidated feedback during each revision round.
4. Deposit & Payment
A 50% non-refundable deposit is required to commence work. The remaining 50% is due prior to launch. Failure to pay the balance may result in the site not being launched and credentials not being transferred.
5. Revisions
Two rounds of consolidated revisions are included in every package. Each round must be submitted as a single written list — not drip-fed over multiple messages. Once both rounds are used, additional changes are billed at $75/hour. Scope changes beyond the original brief are handled separately.
6. Timeline
Estimated timelines are provided in good faith. Typical turnaround is 2–3 weeks from deposit to launch. Delays caused by the client — late content, slow feedback — may extend the timeline without penalty to Buildabase.
7. Ownership
Full ownership of the site — including all files, code, and credentials — transfers to the client upon receipt of final payment. Prior to final payment, all work remains the intellectual property of Buildabase.
8. Hosting
The client is responsible for maintaining their domain registration and any third-party accounts (Vercel, email provider). Buildabase is not liable for service interruptions caused by third-party providers after handover.
9. Cancellation
Cancellation after commencement forfeits the deposit. If Buildabase cancels the project for any reason, a full refund of the deposit will be issued within 14 days.
10. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the project.
11. Limitation of Liability
Buildabase's total liability is limited to the fees paid for the project. No liability is accepted for indirect losses, lost revenue, or data loss arising after handover.
12. Governing Law
These terms are governed by the laws of Tasmania, Australia. ABN: 47 592 199 601.
